Terms of Service
These terms are an agreement between you and Race Chief ("we", "us") covering the Race Chief mobile game (the "Game") and this website. By downloading or playing the Game you agree to them. If you don't agree, please don't play. Where you got the Game from the App Store or Google Play, that store's terms also apply, and their rules win if the two conflict.
These Terms are between you and Herbacy Inc. ("Race Chief", "we", "us"), the publisher of the Game and the Site. Registered address: AYC Marina and Resort, Falmouth, Antigua & Barbuda. Contact: support@racechiefgame.com.
1. Who can play
You must be old enough to agree to these terms where you live, or have a parent or guardian's permission. The Game's age rating differs between stores and countries, and the Game includes randomised items (Scouts, each of which signs a random driver) that can be bought with gems, which can be bought with real money, so please check your store's age rating.
2. Your licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and play the Game on devices you own or control, for your own entertainment. You may not copy, modify, reverse-engineer, sell, rent or distribute the Game or any part of it, or use it to build a competing product, except where the law expressly allows.
3. Virtual items and currency
Cash, gems, plaques, drivers, bikes, cars, cosmetics and every other in-game item ("Virtual Items") are licensed to you, not sold. They have no real-world value, cannot be exchanged for money, and cannot be transferred outside the Game. We may change, rebalance, or remove Virtual Items as the Game evolves; where we do, we will try to be fair about it.
Your gem balance, and the drivers you sign through Scouting, are kept on our servers, and our servers' record is the one that counts. Our servers check what the Game reports, and we may automatically hold, correct or remove gems, drivers and other Virtual Items that our checks find implausible, that came from breaking these terms, or that came from a purchase later refunded. If you think we got it wrong, email support@racechiefgame.com with your Player ID (shown in the Game's Settings) and a person will review it.
4. Purchases and refunds
- All purchases are made through the App Store or Google Play and are subject to their payment terms. Prices are shown before you confirm, in your local currency, including any tax the store applies.
- Pit Pass (one-off). The one-off Pit Pass is a one-time purchase that lasts 28 days from when you buy it; one bought in the last 72 hours of a Pit Pass that is still running starts when that one ends. It does not renew automatically and there is nothing to cancel; buy it again if you want another 28 days. Rewards already earned stay with you when it ends.
- Pit Pass subscription (auto-renewing; added 10 October 2026). Where the Game offers it, the Pit Pass is also sold as an auto-renewing subscription (
com.herbacy.racechief.pit_pass_sub) at US$4.99 per period, or the equivalent shown by your store; prices may vary by country and are shown before you confirm. One period is 1 month on the App Store and 4 weeks on Google Play. Payment is charged to your Apple ID or Google Play account when you confirm the purchase. The subscription renews automatically at the end of each period, at the same price unless you are told of a change in advance, and your account is charged for each renewal until you cancel: on the App Store within 24 hours before the period ends, on Google Play on the renewal date. To avoid the next renewal, cancel at least 24 hours before the end of the current period, in your App Store account settings (Settings › your name › Subscriptions) or in Google Play (Payments & subscriptions › Subscriptions); deleting the Game does not cancel it. After you cancel, the Pit Pass runs to the end of the period you have paid for and then stops; there are no refunds for a partly used period except where the store's policy or the law gives you one. If a free trial or introductory price is offered, any unused part of it is forfeited when you buy a subscription, and during an introductory period the Legendary driver, the subscriber bonus gems and the exclusive cosmetic (or its gems) come with the first full-price period. In the Game, the one-off Pit Pass and the subscription are offered side by side in the same Pit Pass window, so you can choose which one to buy. While the subscription is active, each period gives you a Pit Pass season with the same track and rewards as the one-off Pit Pass, plus the subscriber extras shown in the Game when you subscribe (such as bonus gems or an exclusive cosmetic); rewards already earned stay with you when it ends. - The Starter Pack, Rookie Kit, New Team Kit and Team Sale Kit can each be bought once, and are offered only at certain points in the Game, some for a limited time. No Ads and the Gems Fund are bought once and kept. Gem packs can be bought as often as you like. What a product contains is shown before you buy, and nothing sold for real money is random.
- Refunds are handled by the store under its policy; we cannot process refunds directly. When a purchase is refunded, its gems are removed from your balance and anything it still provides (such as No Ads, or further Pit Pass or Gems Fund rewards) stops; if its gems were already spent, the amount spent is recorded as owed and taken from gems you receive later.
- Right of withdrawal (EU and UK; added 12 October 2026). If you live in the European Union or the United Kingdom, you normally have 14 days to withdraw from a contract made at a distance. Everything sold in the Game is digital content supplied as soon as the purchase completes (gems, the Starter Pack and kits, No Ads, the Gems Fund and the Pit Pass). By confirming a purchase you ask for it to be supplied at once and acknowledge that you lose the right of withdrawal once supply has begun. The store you buy from (Apple or Google) is the seller, asks for that consent at checkout and handles any withdrawal or refund under its own terms and the law. You can cancel a subscription at any time as described above. Nothing here limits any right you have by law.
- Scouts are randomised: each one signs a random driver. The odds for each rarity are shown in the Game before you scout, and every randomised reward's odds are listed on our odds page. Prize crates that drop beside the track are free: tap one to open it (some are claimed by watching an optional ad).
5. Fair play
Don't cheat. That includes modifying the Game or its save data, exploiting bugs, using bots or automation, manipulating the device clock to gain offline earnings, or interfering with the weekly championship. Race results are computed deterministically. Our servers check gem earnings and spending automatically and may hold or correct an account's balance (section 3); holds are reviewed by a person. We may also reset progress, remove Virtual Items, or block access for accounts that break these rules. Abusive contact with other players or with us is not tolerated.
6. Custom Chief and names you type
Custom Chief, an AI-drawn portrait of your Chief made from a description you type, is not available yet. When it opens, these rules apply to it:
- Describe only the look of a made-up person. Don't ask for a real person (famous or not), a named character from a film, game or book, a brand, logo, team or other trademark, a child or anyone under 18, or anything sexual, hateful, violent or otherwise offensive or unsafe, and don't put instructions, writing or contact details in a description. Our checks refuse such descriptions and portraits automatically.
- A refused description costs nothing. If an order, or a paid redraw, produces no portrait that passes our checks, its gems are returned. Once a portrait is delivered the gems are spent, including when a ready order closes after 7 days without a pick (its portraits are kept in your collection).
- We may refuse an order, and remove or stop showing any portrait, including one you picked or kept, if it breaks these terms or is reported. Reports are reviewed by a person. When we remove a portrait we may, at our choice, return its gems.
- You keep any rights you have in what you write. You give us a worldwide, non-exclusive, royalty-free licence to use your description to make and check your portraits, and to host, store and copy the portraits made for you, and to show the portrait you wear to other players in the Game (for example your club) while it is your Chief, and as needed for moderation and backups. Portraits are Virtual Items under section 3, for use in the Game only.
The same rules apply to a Chief name you type in Settings: no real people, brands, offensive words or contact details. We may hide or replace a name that breaks them.
7. Ads
The Game offers optional rewarded ads. Watching one is always your choice. Ads are supplied by third-party networks and we don't control their content; report anything inappropriate to support@racechiefgame.com.
8. Availability and changes
We may update, change, suspend or discontinue the Game or any feature at any time, including online features such as cloud save and sign-in. We'll give reasonable notice of a full shutdown where we can. We don't guarantee the Game will always be available or error-free.
9. Our content
The Game, its art, characters, names, code and music are owned by us or our licensors and protected by copyright and trademark law. "Race Chief" and the helmet logo are our marks. Team, driver and circuit names in the Game are fictional; any resemblance to real people, teams or places is coincidental.
10. Disclaimers and liability
The Game is provided "as is". To the fullest extent the law allows, we exclude all warranties, and our total liability to you for anything arising from the Game is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law, including for death, personal injury, or fraud, and nothing affects consumer rights you have under the law of your country.
11. Termination
You can stop playing and delete the Game at any time. We can end your licence if you materially breach these terms. Sections 3, 6, 9, 10 and 12 survive termination.
12. Governing law
These terms are governed by the law of the country in which we are established, without prejudice to any mandatory consumer protection you enjoy where you live. Disputes will be brought in the courts of that country unless the law gives you the right to bring them where you live.
13. Changes to these terms
We may update these terms. We'll post the new version here with a new effective date, and for material changes we'll notify you in the Game. Continuing to play after that means you accept them.
